1. About Daylyf

Daylyf operates a marketplace where verified guests can book private homes and spaces by the hour for daytime use only. Daylyf is not a hotel, not a short-let operator, and not a place to spend the night. We provide the platform and trust layer; the host provides the space.

By creating a Daylyf account or using the Daylyf app you agree to these Terms of Service ("Terms"). If you do not agree, do not create an account or make a booking.

These Terms form a legally binding contract between you and Daylyf Ltd, a company registered in England and Wales (registered office: 32 Balfour Road, Northampton NN2 6JR, United Kingdom; company number to be added before launch). They are governed by the laws of England and Wales.

2. Eligibility

To use Daylyf you must:

  1. Be at least 18 years old.
  2. Have full legal capacity to enter contracts.
  3. Provide accurate, current, and complete information.
  4. Complete identity verification (Tier 1 KYC: Verified ID + Verified Email + Verified Phone) before making a booking. Daylyf calls this the Booking Access Gate.

We may refuse, suspend, or terminate your account at any time if any of these conditions is not met or stops being true.

3. Your account

You are responsible for:

  • Keeping your sign-in credentials secret.
  • All activity under your account.
  • Notifying us immediately at [email protected] if you suspect unauthorised access.

We use Cloudflare Turnstile and per-account lockouts to defend against unauthorised sign-in attempts. Repeated failed sign-ins will temporarily lock your account.

You may operate Daylyf in Guest Mode or Host Mode. Switching to Host Mode requires additional KYC and host onboarding (see the separate Host Agreement).

4. Bookings

4.1 What you're booking

A "Daycation" is a fixed-hour, daytime-only use of a host's space. Overnight stays are strictly prohibited and constitute a material breach of these Terms.

When you book, you select:

  • A date,
  • An arrival hour (within the host's check-in window),
  • A departure hour (within the host's check-out window),
  • The number of adults and children in your party,
  • The number and type of pets if the listing is pet-friendly,
  • Vehicle registration if you bring a car to a parking-equipped listing.

Total party size (adults + children) must not exceed the host's listing capacity. Daylyf enforces a maximum of 2 pets per booking on pet-friendly listings.

4.2 Pricing

The total price displayed before you confirm is the price you pay. Prices are set by the host using the Daylyf pricing matrix (Base + Tier 1–3 + Max windows). Daylyf charges hosts a 13% platform fee on each booking. There are no booking fees added on top of the listed price for guests at this time.

All prices are in Pounds Sterling (£) unless stated otherwise.

4.3 Confirmation

A booking is confirmed when:

  • You have completed payment (when Stripe payments are live), and
  • The booking status moves from pending_payment to confirmed.

You will receive an in-app confirmation, an automatic check-in instructions message from the host (or auto-shipped self check-in instructions if the host opted in), and an email receipt.

4.4 The "No Noise" policy

Daylyf strictly enforces a No Noise policy at every listing. You agree that:

  • You will not host parties, gatherings, or events generating noise that could disturb neighbours.
  • You will follow all house rules set by the host.
  • A reported noise breach may result in immediate cancellation, forfeit of payment, and a permanent ban from Daylyf.

4.5 Cancellation & refunds (planned)

Until our cancellation engine is live, refunds are handled manually through [email protected] on a case-by-case basis. The intended policy is:

  • Cancel 48+ hours before check-in: full refund.
  • Cancel 24–48 hours before check-in: 50% refund.
  • Cancel less than 24 hours before check-in: no refund.
  • Host cancellation: full refund + Daylyf-funded credit toward a future booking.

Final refund terms will be confirmed in-app at the point of cancellation.

4.6 Check-in (Forensic Camera)

At the start of your booking you must "Clock in" inside the app. This captures a live photo (gallery uploads are blocked), proximity location, and the what3words address of the listing. This forensic check-in protects both guest and host in the event of a dispute. By booking you consent to this capture.

5. Host listings (when you're a guest)

Listings are created by independent hosts. Daylyf:

  • Verifies host KYC and bank/payout details.
  • Reviews listing photos for "live capture" provenance.
  • Enforces the No Noise policy.

But Daylyf:

  • Does not physically inspect every listing.
  • Does not guarantee that every detail in a listing description is accurate.
  • Is not the host of the listing and is not party to the use-of-space contract you form with the host.

You agree that any dispute over the condition of a listing is primarily between you and the host. Daylyf will mediate in good faith.

6. Acceptable use

You will not:

  • Use Daylyf to do anything illegal.
  • Stay overnight at any listing.
  • Sublet, advertise, or resell access to a booked space.
  • Hold a party, event, or commercial gathering without explicit prior host approval and listing-permitted use.
  • Post abusive, threatening, fraudulent, or sexually explicit content in messages or reviews.
  • Attempt to circumvent the Booking Access Gate or any other security control.
  • Scrape, copy, or reverse engineer the app or the API.
  • Bring more guests, children, or pets than the booking allows.

We reserve the right to remove content, suspend your account, void bookings, retain payments, and report you to law enforcement for any breach.

7. Reviews (when launched)

If you submit a review, you grant Daylyf a worldwide, royalty-free licence to display, edit (for length / clarity), and remove that review. Reviews must be honest, factual, and free from threats or hate speech.

8. Intellectual property

The Daylyf brand, app, software, design system, and all related materials are owned by Daylyf Ltd. You may use them only as needed to use the service. You retain ownership of content you upload (your listing photos, your messages, your reviews) but grant Daylyf a worldwide, royalty-free, sub-licensable licence to host, display, and use that content for the purpose of operating Daylyf.

9. Liability

To the maximum extent permitted by law:

  • Daylyf provides the platform "as is" and "as available".
  • Daylyf does not warrant that the app will be uninterrupted, error-free, or free from harmful components.
  • Daylyf's total liability to you for any claim arising out of or relating to your use of Daylyf is capped at the greater of (a) the total fees Daylyf received from you in the 12 months preceding the claim, or (b) £100.
  • Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.

10. Indemnity

You agree to indemnify and hold Daylyf, its directors, employees, and contractors harmless from any claim, demand, or loss (including reasonable legal fees) arising out of:

  • Your breach of these Terms,
  • Your use of any listing,
  • Your content (messages, reviews, photos),
  • Your violation of any law or third-party right.

11. Termination

You may stop using Daylyf at any time and delete your account in Profile → Legal & Account → Delete my account or by emailing [email protected].

We may suspend or terminate your account if you breach these Terms, fail KYC, are reported for safety reasons, or where required by law. We will tell you why unless prevented by law or a credible safety reason.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app and by email at least 14 days before they take effect. Continuing to use Daylyf after a change means you accept the updated Terms.

13. Disputes & governing law

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

We strongly encourage you to email [email protected] before starting any formal proceedings — most disputes can be resolved quickly that way.
